Claim for Rape and Sexual Assault
Claim for rape and sexual assault. If you have been the victim of rape or sexual assault you may wish to claim compensation and damages for your injuries whether they are physical or mental. We can give you the advice and assistance you need.
As a victim and survivor of sexual assault and or rape, there are three possible methods of claiming the compensation that you deserve.
Application for an award to the CICA.
You are entitled to claim an award from the Criminal Injuries Compensation Authority (CICA). The CICA is a government-funded organisation that makes payment to the victims of violent crimes and this includes a payment to the victims of rape and sexual assault.

Make a civil claim against your attacker direct.
You can sue the person who attacked you and claim compensation in the same way that you would sue someone who had crashed into you. The principle is the same; you have suffered injury and loss as a result of their actions. You are entitled to make recovery for your losses.
Such cases can be problematic as any compensation will have to come from your attacker’s personal wealth/property/pension as they will not have insurance to cover their illegal actions.

Make a civil claim for rape and sexual assault against your attacker’s employers (your employer)
You can make a claim for rape or sexual assault if the attack was by a colleague. In such a case it may be possible to bring a claim against your employers for the actions of another employee.
Such a claim can only be brought in certain circumstances . It allows you to make the recovery of any compensation directly from your employer’s insurers. This removes the need for having to claim it from an individual who will not have insurance to cover such.
Make a civil claim for rape and sexual assault against your attacker’s employers (not your employer)
In some cases, you may be able to bring your claim against your attacker’s employer. We will need to show that there is a link between the employment and the assault. An example is if you were sexually assaulted by a doctor while undergoing a medical examination.
